TERMS OF USE AND SALE

Last updated: 28 September 2026

These Terms of Use and Sale govern access to and use of Via Originis and the purchase and use of digital routes and related digital services.

By creating an account, purchasing a route or using a purchased route, you agree to these Terms.

2. WHAT VIA ORIGINIS PROVIDES

Via Originis provides self-guided digital walking routes and related digital content designed to help users independently explore destinations.

A Via Originis route may include, depending on the route:

  • mapped walking paths;
  • route stops;
  • points of interest;
  • editorial information;
  • discoveries and route context;
  • navigation-related information;
  • route progress features;
  • downloadable or offline-compatible content.

The exact features available may vary by route, device, browser and product version.

Via Originis does not provide a live human guide unless a separate product expressly states otherwise.

3. ACCOUNT

Certain Via Originis features require an account.

You are responsible for maintaining access to the email address or authentication provider associated with your account and for activity performed through your account.

You must provide accurate information when information is requested for account, purchase or billing purposes.

Accounts are intended for individual use unless Via Originis expressly offers another type of licence.

4. PURCHASES

The price shown for a route before checkout is the price payable for that route, subject to any mandatory taxes or charges that must legally be added.

Any applicable total amount is shown before the purchase is completed.

Payment is processed through Stripe.

Via Originis does not directly receive or store your complete payment card number.

A purchase is considered completed when payment has been successfully confirmed and Via Originis grants access to the purchased route.

An order confirmation or route-ready communication may be sent to the email address associated with the account or purchase.

5. DIGITAL DELIVERY

Purchased routes are delivered digitally.

Once payment has been successfully confirmed, the purchased route is normally added to the user's Via Originis account and made available through My Routes.

Access may require:

  • a compatible phone or browser;
  • an internet connection for initial access or certain features;
  • location permission for location-aware walking features;
  • sufficient device storage if optional offline content is downloaded.

Where offline access is available, downloading the route is optional unless expressly stated otherwise.

6. LICENCE TO USE PURCHASED ROUTES

A purchase grants you a limited, personal, non-exclusive and non-transferable right to access and use the purchased route for personal purposes.

You do not acquire ownership of Via Originis content, software, route design, editorial content, images, graphics, maps, branding or other intellectual property.

You may not, without prior written permission:

  • reproduce or redistribute a route;
  • resell access to a route;
  • publish substantial parts of the route content;
  • make route content publicly available;
  • copy or extract Via Originis content for commercial use;
  • reverse engineer, circumvent or interfere with access controls.

Reasonable personal use with friends or family walking together is not prohibited merely because more than one person is physically present during the walk.

7. ROUTE AVAILABILITY AND CHANGES

Cities and public spaces change.

Roadworks, construction, weather, closures, transport disruption, events, opening hours, temporary access restrictions and other circumstances may affect a route.

Via Originis may update route content, route paths, stops or technical delivery when reasonably necessary.

Via Originis does not guarantee that every point of interest, business, street, attraction or facility will remain accessible or unchanged at all times.

8. LOCATION FEATURES

Certain walking features may use your device's location to determine your position relative to the route.

Where location permission is requested, you may deny the permission.

Some location-aware features may not function correctly if location access is unavailable.

Via Originis does not currently use your live walking location to create a server-side location history.

Further information is available in the Privacy Policy.

9. USER RESPONSIBILITY AND SAFETY

Via Originis is a self-guided digital product.

You remain responsible for your own decisions, movements and personal safety while following a route.

Always pay attention to:

  • traffic;
  • crossings;
  • signs;
  • local laws and regulations;
  • barriers and closures;
  • terrain and weather;
  • instructions from public authorities;
  • your surroundings.

Do not use your phone in a way that creates a safety risk.

A route displayed on a screen does not override road signs, traffic rules, official instructions or physical conditions encountered in the real world.

You are responsible for deciding whether a route and its conditions are suitable for you.

10. THIRD-PARTY PLACES AND SERVICES

Routes may refer to public places, attractions, restaurants, shops, transport services or other third-party locations.

Unless expressly stated otherwise, Via Originis does not operate or control those third parties.

References to third-party places do not guarantee:

  • opening;
  • availability;
  • admission;
  • pricing;
  • service quality;
  • safety;
  • accessibility.

Any transaction entered into directly with a third party is separate from your purchase from Via Originis.

11. OFFLINE ACCESS

Where a route supports offline access, the user may choose to download available route content to the device.

A route being owned does not automatically mean that it has been downloaded.

Offline functionality may depend on:

  • successful completion of the download;
  • available device storage;
  • browser or operating-system storage policies;
  • content previously stored on the device.

Some external or dynamic information may require an internet connection.

12. REFUNDS AND CANCELLATIONS

Refunds and cancellations are governed by the Via Originis Refund and Cancellation Policy.

Swiss law does not provide a general statutory cooling-off period for ordinary online purchases.

However, mandatory consumer rights applicable under the law of another country remain unaffected.

For digital content supplied to consumers in jurisdictions where a withdrawal right applies, additional requirements or exceptions may apply, including where the consumer expressly requests immediate supply of digital content and acknowledges the consequences for the withdrawal right.

13. INTELLECTUAL PROPERTY

Via Originis, its branding, route structure, editorial content, designs, software, photography, video, graphics and other original materials are protected by applicable intellectual-property laws.

Third-party maps, data, trademarks and materials remain the property of their respective owners.

No licence is granted except the limited personal-use licence expressly described in these Terms.

14. SERVICE AVAILABILITY

Via Originis aims to keep the platform available and functional but does not guarantee uninterrupted or error-free operation.

Temporary interruption may occur due to:

  • maintenance;
  • updates;
  • third-party service outages;
  • connectivity issues;
  • security incidents;
  • technical failures;
  • circumstances beyond reasonable control.

Where a technical problem materially prevents access to a paid route, users should contact support.

15. LIABILITY

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

To the extent permitted by law, Via Originis is not responsible for losses caused solely by:

  • a user's failure to follow traffic rules or official instructions;
  • third-party closures, changes or service failures;
  • weather or natural conditions;
  • device failure;
  • lack of connectivity;
  • inaccurate third-party information;
  • use of the service contrary to these Terms.

Via Originis remains responsible for obligations that cannot legally be excluded.

16. ACCOUNT DELETION

Users may request or initiate account deletion through available account controls.

Account deletion may remove account access, route entitlements and certain account-linked data.

Certain transaction and purchase records may be retained where necessary for accounting, legal, fraud-prevention, dispute-resolution or other legitimate business obligations.

Further details are described in the Privacy Policy.

17. SUPPORT

For product access, technical problems, payments, invoices or refund requests:

[email protected]

18. CHANGES TO THESE TERMS

Via Originis may update these Terms where reasonably necessary to reflect changes in:

  • the product;
  • applicable law;
  • technical systems;
  • business operations.

The current version will be published on the Via Originis website with the date of the latest update.

Changes will not retroactively remove mandatory rights already acquired by a customer.

19. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law.

20. GOVERNING LAW AND JURISDICTION

These Terms are governed by Swiss law.

Where legally permitted, disputes are subject to the competent courts at the registered seat of Roriz Gama Via Originis in the Canton of Zurich, Switzerland.

Mandatory consumer-protection rules and mandatory jurisdiction rights remain unaffected.
